Information about Dismissal Types
In Spain there are different types of dismissal, each with its own compensation:
Objective Dismissal: 20 days per year worked, maximum 12 months
Unfair Dismissal: 33 days per year worked, maximum 24 months
Collective Dismissal: 20 days per year worked, maximum 12 months
End of temporary contract: 12 days per year worked, no cap (does not apply to training or replacement contracts)
Fair disciplinary dismissal: No compensation. An objective dismissal ruled fair still keeps its 20 days per year.
Contracts signed before 12/02/2012: in an unfair dismissal, the time worked up to that date is paid at 45 days per year and the time after at 33. The cap is 720 days of salary, unless the earlier period alone exceeds that; then the cap is what that period gives, never above 42 monthly payments.
